01

Acceptance

By using the site or creating a Striker account you accept these terms. If you act for a company, you represent that you can bind it.

02

Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account.

The customer controls which users it invites and what permissions it grants within its organization. Data is isolated by organization.

03

License

Subject to applicable fees and compliance with these terms, Tyrell grants the customer a limited, non-exclusive, non-transferable license to use Striker for the subscribed term. You may not sublicense, resell, decompile, or use Striker to build a substantially similar competing product, except with written permission or where mandatory law allows.

04

Acceptable use

You must use Striker lawfully and in line with these terms, Law 19.628, and the policies of third parties you connect. You may not do any of the following:

  • 01

Send spam, unsolicited messages, or campaigns without a lawful basis.

  • 02

Engage in phishing, impersonation, harassment, or unlawful content.

  • 03

Scrape data or abuse the service without authorization.

  • 04

Process children’s data or categories prohibited by law.

  • 05

Evade limits, policies, or restrictions of Meta, WhatsApp, or Instagram.

05

Fees

Published prices are indicative. Plan, currency, and charges are confirmed when you subscribe. Non-payment may lead to suspension of access.

06

Messaging and third parties

Tyrell acts as a technology intermediary to operate connected channels. The customer is responsible for the commercial relationship with contacted people and for obtaining consent or another lawful basis before contacting them.

When the customer connects WhatsApp or Instagram, Meta’s terms and policies apply. Other channels and integrations have their own terms.

The customer must honor opt-out and do-not-contact requests. Tyrell does not guarantee that a channel will remain available or that a third party will approve every permission or template.

07

Privacy

The privacy policy is part of these terms. Data deletion is requested through the data deletion page.

08

Intellectual property

Tyrell retains all rights in Striker, the brand, the software, and documentation. The customer retains its content and grants Tyrell a limited license to process it only to provide the service.

09

Confidentiality

Each party will protect the other’s non-public information with at least the same care it uses for its own confidential information, except for public information, information required by law, or information developed independently.

10

Liability

The services are provided “as is” and as available, to the extent Chilean law allows. Tyrell’s total liability for claims related to Striker is limited to amounts the customer paid in the twelve months before the event giving rise to the claim, without prejudice to liability that law does not allow us to limit.

The customer will indemnify Tyrell against claims arising from the customer’s content, the customer’s or its users’ use of Striker, or breach of law, these terms, or third-party policies, except to the extent the claim arises from Tyrell’s gross negligence or willful misconduct.

11

Disputes

Any dispute will be submitted to the ordinary courts of the Republic of Chile.

12

General

We may update these terms; the date in the header shows the current version. If any provision is invalid, the remaining provisions stay in effect. If a signed order or contract with Tyrell exists, that document controls commercial terms.
